SPECIAL SURVEY BY NAMA

 

Thanks to all the members who participated in this survey and returned their questionnaire to the National Secretary.  The final results will be relayed to you in due course.

Only 49% of our members responded!!  Where is the other 51%???  With a survey like this one would expect at least a 75% response.

Although it was highlighted in our e-mail on 4 February that "Confidentiality of your info is guaranteed as only the National Secretary will handle your response" one member refused to fill in the quantity of B/C's and Units they handle with the comment "Too confidential to supply."

Motion of distrust?????

PMR 70 - OWNER'S FAILURE TO MAINTAIN.

 

Is it the responsibility of the owner of a top floor unit who has a leaking patio of waterproofing the patio???

If the patio is registered in the Deeds Office on the Sectional Plan as being part of his section the owner will be responsible for the maintenance.

If the patio is not registered as part of his section it is Common Property and the B/C will be responsible for the maintenance thereof.

 

CLEARANCE CERTIFICATE FOR A SECTION OF THE DEVELOPER.

 

If a developer is an owner of a section, and he sells his section for the first time, is the attorney required to ask for a Clearance Certificate???

Once the B/C has been established (when the first transfer is registered) subsequent transfers from the developer (still first sales) are no different from transfers from other owners (re-sales) in this regard and therefore the conveyancer cannot register without a Clearance Certificate from the B/C.
